Real Estate Photography Service Contract
This is a contract for real estate photography services to be provided by Mark Kubicina. By signing this contract you agree to the following terms and conditions.
In the interest of serving your marketing needs in the most affordable and efficient manner, I have set forth the following industry standard real estate photography licensing of my images. To be clear, the images are not sold to you, they are licensed. This allows me to lower my price dramatically for the time spent shooting and editing compared to other types of photography.
All photos delivered to the client for real estate sales are copyrighted by Mark Kubicina, the photographer, and licensed to be used by the realtor / agent / customer for the purpose of advertising and marketing the property during the CURRENT SALE LISTING at the time of being photographed. This license is not transferrable to any other agent or person(s) or entity. Any usage or possession by a third party is prohibited unless approved in writing by the photographer and may be subject to additional fees (or fines if done without permission). This includes but not limited to architects, builders, stagers, designers, sellers or buyers. Photos may not be edited by anyone other than Mark Kubicina, other than simple cropping. Please contact Mark Kubicina to request additional release for other uses or publication / printing than what is stated herein.
Images will not be made available to another agent who takes over an expired or withdrawn listing. Homeowners must request copies of photos if interested from the photographer (owner) of the images and not the realtor.
Photo Credit is to be given to Mark Kubicina (RedDog Real Estate Photography) when a photo is displayed on social media sites.
Payment must be made before or on the date of the shoot. The following payment methods are available to you: cash or check. Invoices are emailed. Returned checks are subject to a $100.00 returned check fee. Client assumes responsibility for any and all collection costs and legal fees incurred by Mark Kubicina in the event of enforcement of this contract becomes necessary. All legal action shall take place in Cleveland, Ohio.
Mark Kubicina is not responsible for the lack of coverage due to weather conditions, scheduling complications due to lateness of individuals, any restrictions from the property owner, or the rendering of decorations of the location. Mark Kubicina will do his best to fulfill all requests but can make no guarantees all requested images will be delivered. Clients are responsible for cleaning the home, clearing any unwanted items and removing anything they do not want in the photograph. Removal of items via photoshop will be an additional charge at $30 per image.
In the event of severe weather, including but not limited to, a blizzard, severe rain storm, tornado, or other unforeseeable events, Mark Kubicina may make the decision it is unsafe to shoot that day, and a rescheduled date will be decided on with the customer.
Shoot Duration: Depending on the size and grounds of the home and the services ordered, the shoot can take from 1.5 to 5 hours on average to complete. Mark Kubicina works to achieve the most natural and vibrant image through a special technique learned from masters in luxury home photography. This takes a little more time while on site. Please see the PREPARATION page for more information to help your shoot go faster and look the best. Mark Kubicina reserves the creative right to edit and release only those deemed creditable and professional in quality.
Cancellation: There is no cancellation fee if you contact me before I have departed for the shoot. If I am already en route there will be a $30 cancellation fee.
The client(s) hereby acknowledges that they have received, read, and understand Mark Kubicina’s current price, policies, and procedures.
Permission is hereby granted to Mark Kubicina to use any images created under this contract for professional samples, displays, internet website pages, advertising, exhibitions, contests, and any other purpose.
